Privacy Policy

1. ABOUT THIS POLICY 
In Canada, private-sector organizations that collect, use or disclose personal information that crosses provincial or national borders in the course of commercial activities are required to comply with the federal Personal Information Protection and Electronic Documents Act, SC 2000, c 5 (“PIPEDA”). These laws apply in addition to and not in replacement of applicable provincial legislation, such as Ontario’s Freedom of Information and Protection of Privacy Act, RSO 1990, c F.31 (“FOIPP”, together with PIPEDA, the “Privacy Legislation”).

At Navien Canada, Inc. (“NAVIEN”), your Personal Information is handled with the utmost confidence and in compliance with the Privacy Legislation. NAVIEN respects your privacy rights and we are committed to keeping your Personal Information confidential, accurate and secure. As a user of this website (the "Site"), you are valued by us, and we will take appropriate measures to protect the information provided by and collected from you in the Site in connection with the functions, facilitates, products and services offered on our Site. 

This policy applies to the collection, use and sharing of any personal information collected by NAVIEN while conducting our business in Canada, including all websites, webpages, and other services that are published or made available by NAVIEN, including through our parents, subsidiaries, and affiliates (this “Privacy Policy”).  

Within this policy, we explain how we collect, use, share and protect personal information collected by Navien and we provide information about the rights and choices you have regarding your personal information. 

Please note this policy does not apply to information that is not considered personal information including information about a business or company is generally not considered personal information. 

This policy will continue to apply for as long as Navien holds your information, including after the termination of any of your product or service agreements with us. By providing us with information, you are consenting to the collection, use and sharing of your information as set out in this privacy policy. 

We will update this privacy policy and our other privacy-related documents at any time at our sole discretion. Any changes we make to this privacy policy will be effective when we post the revised policy on our websites. By continuing to interact with us after the modified version of the policy has been posted, you are accepting the changes to the policy. It is your responsibility to ensure that you read, understand and accept the latest version of the policy. The date at the top of this policy indicates when it was last revised. If you do not agree with the terms and conditions set forth in this Privacy Policy, you should not access, visit, or use the Site. You are welcome to print or retain a digital copy of this Privacy Policy for future reference. 

2. KEY TERMS 
Personal Information” means information about an identifiable individual, such as contact information, account numbers, demographic information, for example including age, marital status, financial information, biometric information, photographs and signatures, as well as IP addresses 

3. TYPES OF DATA WE COLLECT 
We acquire Personal Information that may include, in certain contexts, your name, street address, postal code, email address, and telephone number. To tailor the Site to your needs, the Personal Information we collect may also include information about your age, gender, and preferred language. We also acquire your IP address, browser, operating system, and the pages of the Site you visit. We also collect transaction information about how you use different products or services such as purchase and sale history. Information you provide to us by various means – for instance if you fill out forms or communicate with us by telephone or email – is also collected.  

4. HOW PERSONAL INFORMATION IS COLLECTED 
When you visit the Site, your consent to the collection and use of your Personal Information as described herein is implied. If required by applicable law, we will also seek your explicit consent to process Personal Information collected on the Site or voluntarily provided by you. Please note that any consent will be entirely voluntary.

The most common way we receive Personal Information is when you provide it to us, often through our Contact Us form. When using this form, you will be prompted to enter your last name, email address, type of inquiry, and a message you’d like us to receive. In addition, it is often helpful if you provide us with your first name, street address, phone number, and/or customer type so that we may better respond to your inquiry. 

We may also request that you input or allow us access to your geographic location when using the Rebate Finder, Installer/Service Locator, and Distributor/Sales Rep Locator, as these tools perform best when the most accurate information is available. Please be aware that you alone are responsible for the content of your responses when using these tools. 

In addition, we use Google Analytics to automatically collect and store information about how visitors use the Site so that we may make improvements and give visitors a better user experience. Google Analytics is a third-party information storage system that records information including the pages you visit, the length of time you were on specific pages and the website in general, how you arrived at the site, and what you clicked on when you were there. 5. HOW PERSONAL INFORMATION IS USED 
When we make reference to sharing information within NAVIEN, we also mean sharing among NAVIEN, including its parent, subsidiaries and affiliates.

We use and share Personal Information to: 

(a) Provide you with products and services; 

(b) Communicate with you and to process and respond to your requests for information regarding the Site or our products or services and to inform you of services we think may be of interest to you; and,  

(c) Manage our business. As such, we may use and share your Personal Information for any lawful business purpose in connection with administering the Site, including for customer service, diagnosing potential problems with our servers, improving our product offerings by tailoring them to your needs, gathering broad demographic information to analyze trends, seek compatible advertisers, clients, and customers, and to track users’ movement around the Site. As noted above, your geographic location information may specifically be used to show you content based on geographic location, including rebates, installers, service providers, distributors, or sales representatives in your area. 
 
We will only collect Personal Information for the purposes and uses described in this Privacy Policy. We will not without your express consent use your Personal Information for any other purposes except as may be reasonably anticipated by you having regard to the nature of our business. We will inform you of additional purposes which are not contemplated by this Privacy Policy and if necessary, we will seek your consent should we desire to collect, use or disclose your Personal Information for such additional purposes or uses. 

6. DISCLOSURE OF PERSONAL INFORMATION 
We may disclose Personal Information to our service providers and other vendors, such as those who obtain reviews and testimonials and otherwise help us operate our business. Otherwise, NAVIEN will not disclose, sell, trade, or rent Personal Information without your prior consent, except to the extent necessary to provide you with a requested NAVIEN service. In certain rare circumstances, we may be compelled by law to disclose your Personal Information, such as in connection with a lawsuit or other legal proceeding. In the event disclosure is required, we will use reasonable efforts to secure Personal Information, including prohibiting the use of the Personal Information for any commercial purpose. We will only disclose your Personal Information without your knowledge or consent where permitted by law, including pursuant to the relevant Privacy Legislation. This may include, but is not limited to, disclosing Personal Information: 

• in instances where NAVIEN is compelled to comply with a subpoena, warrant or court order; 

• for the purpose of collecting a debt owed by an individual to NAVIEN; or 

• because of an emergency that threatens the life, health or security of an individual. 

7. PROTECTION OF INFORMATION 
At NAVIEN, we take the protection of your Personal Information seriously. We make reasonable efforts to prevent unauthorized use, sharing, loss and theft of information. Our employees who have access to your information are aware of the importance of keeping it confidential. 
NAVIEN will maintain physical, technical and procedural safeguards that are appropriate to the sensitivity of the Personal Information in question. These safeguards are designed to prevent your Personal Information from loss and unauthorized access, copying, use, modification or disclosure. 
No data transmission over the internet, including e-mail, can be guaranteed to be secure. As a result, while we strive to protect your personal information, we cannot warrant the security of any information you transmit to us, and you do so at your own risk. Once information is received, we make commercially reasonable efforts to ensure its security on our systems. Your Personal Information and data may be stored on servers in or outside your jurisdiction.  
The Site may contain links to non-NAVIEN sites. NAVIEN is not responsible for the information and privacy practices of these third-party sites. We recommend that you read any such third-party sites’ privacy policies to learn about their information and privacy practices before you provide any Personal Information.  

8. WHERE YOUR INFORMATION IS STORED AND FOR HOW LONG 
The length of time we keep your information will vary depending on the product or service and the type of information we have. We keep your information for as long as we reasonably need it for customer service, legal or reasonable business purposes. For these reasons, we keep your information beyond the end of your relationship with us. When your information is no longer required, we securely destroy it or make it anonymous or securely store it. Depending on the nature of the information, your information may be stored in NAVIEN office(s) where we regularly do business, in computer systems or in the record storage facilities of NAVIEN or our service providers. 
Information may be stored and processed in any country where we have affiliates or service providers. By using our products or services, you consent to the transfer of information to countries outside of Canada, including the United States, which may provide different data protection rules. NAVIEN service providers and other third parties, including NAVIEN affiliates, with whom we share information under this policy, may perform activities outside of Canada. As a result, your information may be securely used, stored or accessed in other countries and be subject to the laws of those countries. For example, information may be shared in response to valid demands or requests from government authorities, courts and law enforcement officials in those countries 

9. NON-CONFIDENTIAL INFORMATION 
If you send us ideas, comments, suggestions, or questions regarding NAVIEN’s products or services or the content of this Site, NAVIEN may use, disclose, or distribute that non-personal information to others without your permission or knowledge. NAVIEN may use ideas, concepts, or techniques you send us for any purpose, including to develop or market our products. If you desire confidential treatment of any ideas, concepts, or techniques, please write to the address below.

 
10. THIRD PARTY ADVERTISERS AND LINKS 
As you access and use the Site, our advertisers, promotional partners or other third parties may use cookies or other technology to attempt to identify some of your preferences or retrieve information about you. Although these activities may appear to be coming from our Site, they may be coming directly from third parties. As set out in Clause 7, we do not control the use of this technology or the resulting information and are not responsible for any actions or policies of such third parties. 
As you access and use the Site, you may link to, or view as part of a frame on the Site, certain content that is created or hosted by a third party. Third parties, including our partners, advertisers, social media applications, content sharing and peer to peer networks, as well as other content providers accessible through Site may have their own privacy and data collection policies and practices. We are not responsible for the actions, privacy, security or content of such third parties. If you are asked to provide information to these third parties, we encourage you to carefully review their privacy policy and terms of use before sharing your information.


11. ACCESS TO PERSONAL INFORMATION 
Subject to exceptions as permitted by law and upon your written request, we will inform you of the existence, use and disclosure of your Personal Information and give you access to that information. If you desire access to your Personal Information, to correct existing Personal Information, or to remove your Personal Information, please contact us by using Contact Us link at the bottom of this webpage. Upon receiving your request, we will delete your Personal Information from our records within a reasonable time. 
In certain situations, we may not be able to provide access to all the Personal Information that we hold about you, for example, if access would reveal Personal Information about another individual or reveal confidential commercial information. If access is denied, we will provide the reasons for denying access and the forms of recourse that you have. We will respond to your request within a reasonable time and not later than the time required by law, subject to extensions permitted by law, in which case we will notify the person of such extension, the reason for the extension, the time when a response from us can be expected and the types of recourse a person may have in relation to the decision to extend.


12. INDIVIDUAL RIGHTS 
To exercise your rights to submit any verifiable consumer request, you (or your authorized representative) may submit a request by contacting us using the Contact Us link at the bottom of this webpage. Please note that to verify your identity and properly process your request, you may be required to provide certain Personal Information to us prior to accessing any records containing such information. 
You have the right to obtain information about our processing of your Personal Information and to obtain a copy of your Personal Information that we store. You also have the right to request that we access, correct, or amend your Personal Information if what is held is incorrect or incomplete in some way. Similarly, you may also withdraw consent to the use of your Personal Information.


13. CHILDREN’S POLICY 
Our Site and mobile application are not intended to attract children under the age of 18. Please contact us using the Contact Us link at the bottom of this webpage and we will promptly remove any Personal Information about a child under the age of 18 from our records.


14. CHANGES TO THIS PRIVACY POLICY 
NAVIEN may update this Privacy Policy and our other privacy-related documents at any time at our sole discretion. Any changes we make to this Privacy Policy will be effective when we post the revised policy on our websites.
